These Terms of Use (“Terms”) govern your access to and use of Shiftpace LLC (“Shiftpace,” “we,” “us,” or “our”) websites, mobile applications, and related services (collectively, the “Services”).

Acceptance of terms

By accessing or using a Service, you agree to these Terms. If you do not agree, do not use the Service.

Services and availability

Service features, product names, and availability may change over time. We may modify, suspend, or discontinue a Service or feature where permitted by law.

Mobile applications

Our mobile applications are licensed, not sold, to you for your personal, non-commercial use, subject to these Terms and the terms of the applicable app store. For iOS applications, the Apple Standard Licensed Application End User License Agreement applies in addition to these Terms.

Subscriptions and purchases

Some Services offer auto-renewable subscriptions or other in-app purchases. The applicable Service presents the available plan, price, billing period, any trial or introductory offer, and renewal terms before purchase. A subscription gives access only to the features identified in that Service.

Purchases are processed by the applicable app store. Where a subscription is auto-renewable, it renews unless cancelled through your app-store account settings at least 24 hours before the end of the current billing period. You can manage or cancel subscriptions through those settings. Refunds are handled according to the app store’s policies.

Intellectual property

The Shiftpace name, branding, Service content, and related materials are owned by Shiftpace LLC or its licensors and may not be used without prior permission, except as allowed by law.

Acceptable use

You agree not to:

• Use a Service in any unlawful manner
• Attempt to disrupt or gain unauthorized access to a Service
• Misrepresent your affiliation with Shiftpace

Disclaimer

The Services are provided on an “as is” and “as available” basis. To the fullest extent permitted by law, Shiftpace disclaims warranties of merchantability, fitness for a particular purpose, and non-infringement.

Limitation of liability

To the fullest extent permitted by law, Shiftpace LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Services.

Third-party links

The Services may link to third-party sites. We are not responsible for the content or practices of those sites.

Changes

We may update these Terms from time to time. Continued use of the website after changes become effective constitutes acceptance of the revised Terms.
